Terms and Conditions

These terms cover the use of our website and the messaging program we run. The specific work we do for a client is governed by that client's own written agreement, which takes priority over anything here.

Agreement

By using newgrangemarketing.com, contacting us, or agreeing to receive messages from us, you accept these terms. Newgrange Marketing LLC is an Oklahoma limited liability company. If you do not agree with these terms, please do not use the site.

Text messaging program

What the program is

Newgrange Marketing sends text messages to people who have given us their phone number and agreed to be contacted. Messages include replies to your inquiry, updates about your project, appointment and consultation reminders, and account or billing notices.

How you opt in

You opt in by giving us your mobile number and checking the consent box on our contact form, by texting us first, or by telling us directly that we can text you. Consent to receive marketing text messages is never a condition of buying anything from us.

Message frequency

Message frequency varies depending on your project and how often you contact us. Most people receive a few messages a month.

Cost

Message and data rates may apply. Newgrange Marketing does not charge for text messages, but your mobile carrier may.

How to stop

Reply STOP to any message from us and you will be unsubscribed. You will receive one confirmation and then nothing further. Reply HELP for help, or contact us at (918) 891-0738 or [email protected].

Carriers

Carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and can vary by carrier and location.

Privacy

No mobile information, phone number, or SMS consent is shared with or sold to third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for the full detail.

Services and payment

Our plans are billed monthly in advance. There is no long term contract. You may cancel effective at the end of any paid month by telling us in writing, and you will not be billed again.

Hosting, maintenance, and included edits continue for as long as your plan is active. If payment stops, the service stops.

On cancellation, the site files we built for you are yours. We will hand them over, and we will help point your domain wherever you want it to go. Your domain stays in your name throughout.

What we need from you

You are responsible for the accuracy of the content you give us, and for having the right to use any text, photographs, logos, or other material you supply. You agree not to send us material that infringes someone else's rights or that is unlawful.

Where we run messaging or review requests on your behalf, you are responsible for obtaining valid consent from your own contacts before we message them.

Ownership

The design, text, and images on newgrangemarketing.com belong to Newgrange Marketing LLC. Work produced for a client belongs to that client on the terms set out in their agreement with us. We may show finished work publicly as an example of what we do, unless a client asks us not to.

What we do not promise

We build good websites and we set them up properly. We cannot promise a specific search ranking, a specific number of calls, or a specific amount of revenue, and we will not pretend to. Anyone who does is guessing.

The website is provided as is. To the extent the law allows, Newgrange Marketing LLC is not liable for indirect or consequential losses, and our total liability for any claim is limited to the amount you paid us in the three months before the claim arose.

Third party services

Our services rely on outside providers for hosting, email, payments, and messaging. Interruptions at those providers are outside our control, though we will do what we reasonably can to get things working again.

Governing law

These terms are governed by the laws of the State of Oklahoma, and any dispute will be handled in the courts of Payne County, Oklahoma.

Changes

We may update these terms. The current version is always the one posted here, with the effective date at the top. Continued use of the site or the messaging program after a change means you accept the update.
